NILINK - LEGAL
CONDITIONS GÉNÉRALES DE VENTE
1. PURPOSE
These terms govern the sale, by INKIT GROUP (SASU, RCS Meaux 101 748 762), operator of the NILINK brand, of Pieces in limited, numbered editions through nilink.app.
2. THE PIECES
Each Piece sold belongs to a limited edition of a Model, within a Drop. It carries an individual serial number (e.g. "02 / 68") that is never reassigned. Once a Model's edition is fixed, its total number of Pieces never changes.
3. ORDER
An order becomes final once payment is confirmed. The price shown at the time of order, tax included, is the price that applies. It is fixed on the order and never changes retroactively, even if the catalog changes afterward.
The customer is responsible for the size selected at the time of ordering; we recommend consulting the size guide where available on the Model page before confirming.
4. PAYMENT
Payment is made by credit card. NILINK never stores your card details: payment is processed directly by our provider (Stripe).
Where offered, payment may also be made in bitcoin. The reference price remains the price displayed in euros, tax included. The bitcoin amount is calculated at the time of payment and remains valid for the period shown on the payment page. Payment is confirmed once the transaction has been validated by the payment system. If an order paid in bitcoin is refunded, the refunded amount is determined from the order's price in euros.
5. SHIPPING
See the dedicated "Shipping" page. Delivery times and costs are detailed by zone.
6. DIGITAL IDENTITY AND NFC CHIP
NILINK may associate an NFC chip carrying a unique address (digital passport) with each Piece. This association is a declaration made by NILINK: it is not cryptographic proof of authenticity. The chip can be physically replaced without changing the Piece's number or identifier.
The NFC chip is covered by a 6-month NILINK commercial warranty, in addition to the statutory warranties — see the "Returns & refunds" page.
7. WARRANTIES
Independently of any commercial warranty, Pieces benefit from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) for two years from delivery, and from the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). Where the statutory warranty of conformity applies — including to the NFC chip integrated into the Piece — repair or replacement is carried out at no cost to the customer.
NILINK additionally offers a free 6-month commercial warranty on the functioning of the NFC chip, without prejudice to the statutory warranties — its full terms appear on the "Returns & refunds" page.
In summary, under French law: the consumer has two years from delivery of the goods to invoke the statutory warranty of conformity, without having to prove when the defect appeared; the consumer is entitled to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience; if repair or replacement is refused, delayed beyond thirty days, causes major inconvenience, or fails, the consumer may keep the goods at a reduced price or return them for a full refund; resolution is not available for minor defects; any period during which the goods are immobilised for repair or replacement suspends the remaining warranty; these rights derive from Articles L217-1 to L217-32 of the French Consumer Code; a seller who obstructs the statutory warranty in bad faith incurs a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (Article L241-5); the consumer also benefits from the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code) for two years from discovery of the defect, giving the right to a price reduction or a full refund against return of the goods. The full mandatory notice required by French regulation (annex to Article D211-2 of the Consumer Code) is reproduced in the French version of these terms, which prevails.
8. RIGHT OF WITHDRAWAL AND RETURNS
See the dedicated "Returns & refunds" page. The 14-day right of withdrawal does not apply to Pieces made to the customer's specifications or clearly personalised (Article L221-28, 3° of the French Consumer Code); when a Piece is concerned, this is clearly stated before payment.
9. RETENTION OF TITLE
INKIT GROUP retains ownership of a sold Piece until full payment of the price.
10. PERSONAL DATA
See the "Privacy Policy".
11. GOVERNING LAW
These terms are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent French courts will be those of INKIT GROUP's registered office, subject to mandatory consumer protection rules.
